All pricing for towing services in California is subject to applicable state and local rate regulations. We will provide a clear, itemized invoice for all work completed. You should request a written estimate before authorizing work to begin.
Appointments and service calls are scheduled based on crew and equipment availability. We make every effort to arrive within the estimated response window provided at the time of dispatch, but actual arrival times may vary due to traffic, weather, prior calls, or other conditions beyond our control.
If you need to cancel or reschedule a non-emergency appointment, please notify us as soon as possible by phone or email. Cancellations made after a crew has already been dispatched to your location may be subject to a trip charge to cover the cost of the response.
For emergency towing and recovery calls, cancellation terms will be discussed directly with you at the time of the call.
Payment is due upon completion of service unless otherwise agreed in writing. We accept payment by the methods communicated at the time of service. Invoices not paid within 30 days of the invoice date may be subject to a late fee or referred to a collections process.
If you are submitting a claim to your insurance company, you are still responsible for payment to us directly unless we have a separate written agreement with your insurer. We can provide itemized documentation to support your insurance claim.
Disputes regarding charges must be raised in writing within 10 days of the invoice date. We will review and respond to billing disputes in good faith.
You agree to provide accurate information when requesting service, including your location, the type and condition of your vehicle, and any relevant hazards or special circumstances. Providing inaccurate or incomplete information may affect our ability to safely perform the service and may result in additional charges.
You agree to remove all personal belongings from your vehicle before it leaves the scene or is placed into storage. Bay Point Heavy Duty Towing is not responsible for personal items left in vehicles.
Bay Point Heavy Duty Towing will exercise reasonable care in performing towing and recovery services. However, towing and recovery involves inherent risks, and we cannot guarantee that no additional damage will occur to a vehicle that is already damaged, disabled, or in an unstable position.
To the fullest extent permitted by applicable law, Bay Point Heavy Duty Towing shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services, including but not limited to lost income, loss of use, or delays caused by factors outside our control.
Our total liability for any claim arising from services rendered shall not exceed the amount paid for the specific service giving rise to the claim.

If the parties cannot resolve the dispute through negotiation within 30 days of written notice, either party may pursue remedies available under applicable law. Nothing in this section limits either party from seeking injunctive or emergency relief in a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from these Terms or our services shall be brought in a court of competent jurisdiction in California.
